Terms and Conditions

These terms apply when you use our website and when you buy, rent or order delivery of a container, modification, part or accessory from us. Please read them before you place an order.

About these terms

These terms are an agreement between you and Conex Box For Sale ("we", "us"). By using our website or placing an order, you agree to them. Rentals and rent-to-own plans are also covered by a separate written agreement, which takes priority if it conflicts with these terms.

Quotes and prices

  • Quotes are based on the information you give us, including the container size, type and condition, your delivery address and your site details.
  • Quotes are valid for 7 working days unless the quote says otherwise. Container prices can change with the market, so we may need to re-quote after that.
  • Prices on the website are starting prices for the container only, unless stated otherwise. Delivery, taxes and any extras are shown separately on your quote.
  • If your site turns out to be different from what was described, for example harder to reach, we may need to adjust the delivery price before delivery.

Orders and payment

  • An order is confirmed when you have received and signed our invoice and we have received full payment.
  • Full payment is due when you sign the invoice, so there is no balance to pay later or on delivery.
  • We accept payment by wire transfer.
  • Sales tax is charged where required by law. Tax-exempt organizations must provide a valid exemption certificate before the sale.

Container condition and grades

Containers are sold by condition and grade, as stated on your quote or invoice:

  • New (one-trip): has made a single voyage. Minor scuffs and handling marks are normal.
  • Cargo-worthy: structurally fit to carry cargo by sea. May have dents, surface rust and repairs.
  • Wind and watertight: no holes, and doors that close and seal. Sold for storage, not certified for shipping.
  • As-is: sold with known defects and without any promise about condition beyond what is described.

Used containers will show cosmetic wear such as dents, surface rust, faded or mismatched paint and old markings. These are not defects. Photos on our website may show similar units; ask for photos of the actual unit if that matters to you. Dimensions and weights on our website are typical figures and can vary by manufacturer.

Delivery

Standard delivery takes 5 to 10 days. Delivery is described in our shipping and delivery policy, which forms part of these terms. In particular, you are responsible for preparing your site and making sure the delivery truck can reach it safely.

Inspection on delivery

Please inspect the container when it arrives, check that the unit number matches your paperwork, and note any problems on the delivery receipt. Report any problem with the container's condition or grade to us within 30 days of delivery, with photos. See our refunds and returns policy for what happens next.

Ownership and risk

  • Ownership of a purchased container passes to you when we have received payment in full.
  • Risk of loss or damage passes to you when the container is delivered to your site, or collected by you.
  • Rented containers remain our property. Rent-to-own containers remain our property until all payments under the agreement are made.

Modifications and custom builds

Modifications are quoted separately and built to the specification agreed in writing. Please check the specification carefully, as custom work cannot usually be undone. Cancellation of custom work is covered in our refunds and returns policy.

Your responsibilities

  • Getting any permits, zoning approvals or HOA permission needed for the container and its use
  • Making sure the site, ground and access are suitable and safe for delivery
  • Using the container safely and lawfully, and not storing hazardous materials unless the law allows it
  • For rentals, looking after the container and returning it in the condition required by your rental agreement

Warranties

We promise that a container will match the condition and grade stated on your invoice when it is delivered. We also warrant our containers for the following periods from the delivery date:

  • New (one-trip) containers: 5 years
  • Custom containers: 3 years
  • Used containers: 1 year

Each warranty covers defects in the container's structure, doors and weathertightness under normal use. It does not cover cosmetic wear, damage after delivery, misuse, or modifications made by others. Any warranty for parts and accessories will be stated in writing. To the extent the law allows, we make no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

Limitation of liability

To the extent the law allows, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses such as lost profits, or damage to goods stored in a container. Nothing in these terms limits liability that cannot be limited by law.

Using our website

We work to keep the information on our website accurate, but specifications, availability and prices can change. Website content does not form part of a contract unless it is included in your quote or invoice. You may not copy our content or use the website for unlawful purposes.

Governing law

These terms are governed by the laws of the State of New York and applicable United States federal law. Any disputes will be handled in the state or federal courts located in the State of New York, unless the law requires otherwise.

Changes to these terms

We may update these terms from time to time. The version in effect when you place your order applies to that order.
